The reason why we don’t recognize Durand agreement is that this agreement was signed between Afghanistan and British India and after the collapse of British India this agreement lost its value automatically and had to be lapsed. We should bear in mind that there is no party, group or government to be the rightful owner of British India’s inheritance, only Pakistan is claiming to be the one but based on very funny and weak reasons. Also a vast majority of our Pashton brothers don’t want to be part of Pakistan, their first choice is to have their own separate estate or join Afghanistan, but Pakistani regimes always tried to après them using any kind of force, if you only study FCR law implemented in NWFP, you’ll be able to easily measure the level of aggression used against Pashtons for the propose of controlling them.
To answer your second question I must say that this was Amir Abdulrahman Khan who started limiting and controlling the movements of Kochies by bringing modern governance system to the country, since them Kochies had to pay for any land used by them and latter during King Mohammad Zahir shah’s time most Kochies decided to buy lands, because it was hard for them to afford paying for the usage of the lands every year. You should remember that most of the documents held by Kochies are from the times of King Zahir shah and by not recognizing them we will create a big problem in Afghanistan since half of Afghanistan is built during King Zahir’s time.
